Nebula arrest

Nebula judgment

The Nebula judgment is a 1988 decision of the Supreme Court concerning the liability of a parent company for environmental damage caused by its subsidiary.

The Nebula judgment (HR 23 September 1988, NJ 1989/314) concerns a case in which the Supreme Court ruled on tortious liability in the context of environmental responsibility. The central issue was whether, and under what conditions, a holding company may be held liable for the dumping of chemical waste by one of its subsidiaries.

The judgment is significant in that it refines the criteria for piercing the corporate veil in cases involving serious environmental offences and emphasises the parent company’s duty of care. It provides guidance on the circumstances in which liability may be attributed within a corporate group.

In practice, the judgment is regularly cited in proceedings concerning environmental damage and group liability, with courts assessing whether the holding company has exercised adequate supervision over the subsidiary’s activities.

“In the Nebula judgment, the parent company was held liable for the environmental damage caused by its subsidiary’s dumping of waste.”
