Spoedappel
Urgent appeal
An expedited appeal is an accelerated appellate procedure before the Administrative Jurisdiction Division of the Council of State in cases involving an urgent interest.
An expedited appeal is a special form of appeal in Dutch administrative law by which the appellant requests the Council of State to hear the case on a priority basis. This instrument is used primarily where adherence to ordinary time limits would result in irreparable harm, such as in the case of an imminent removal in immigration proceedings.
The expedited appeal is significant in that it permits swift judicial scrutiny without awaiting the usual processing periods. The Council of State may also grant interim relief to preserve the status quo pending determination of the appeal.
In practice, the expedited appeal is frequently invoked in immigration law and other administrative proceedings in which timely protection of rights is essential.
“The attorney lodged an urgent appeal immediately after the court's ruling to prevent his client's eviction.”
